Last week, the Biden administration released a new and extensive set of rules that expand Title IX’s prohibition of “sex-based discrimination” to include “gender identity.” The rules destroy protections for sex-based accommodations in the American educational system.

Under the new rules, it will constitute unlawful discrimination to keep biological men who “identify” as women out of previously all female spaces. This includes bathrooms, locker rooms, sororities and athletic events.

The ironies are breathtaking. President Biden complains about the mythical gender-based wage gap. But these rules take away something much more precious than a few cents in a paycheck.

Congress passed Title IX to provide women with opportunities. The Biden administration’s new interpretation of it jeopardizes their chance to compete on a level playing field and have access to safe and private spaces. The rules are a travesty that hurts all women.
