The Department of Basic Education (DBE) has lodged an application to set aside the enforcement notice issued by the Information Regulator (IR) regarding the publication of matric results in newspapers. Last month, the IR issued an enforcement notice to the DBE over what it described as noncompliance with the Protection of Personal Information Act (POPI Act). According to spokesperson Elijah Mhlanga, the department filed its papers at the North Gauteng High Court in Pretoria on Friday. With President Cyril Ramaphosa’s 21-day spaza shop registration process deadline fast approaching, the Gauteng government says it will embark on a process to determine those who qualify to own spaza shops. The deadline is five pm on Tuesday. Acting Gauteng Premier, Lebogang Maile has briefed members of the media on their plans in Johannesburg. Maile says they have come across challenges and also successes during the registration process. The spaza shop registration drive comes after the death of a number of children in suspected food poisoning incidents. Thabiso Tema spoke with Lebogang Maile, Gauteng Acting Premier

A recent ruling by the Johannesburg high court in South Africa has put the definition and control of the “family house” under African customary law under the spotlight. The ruling touches on sensitive issues of cultural heritage, statutory laws of property, and South Africa’s history of racial discrimination.It highlights the tension between customary norms, which underlie the idea of a communal family house, and the common law, which restricts ownership to the individual whose name appears in a title deed. The notion of a family house is not provided for in South African law. And prior to this ruling, it was unclear how control in this type of property should be exercised by extended family members.  Thabiso Tema spoke with Benedict Phiri, Founder and Managing Director of IusPrudentia Specialist Counsel.
