South African High Court hears a legal challenge brought by the Democratic Alliance against the Expropriation Act

The Western Cape High Court in South Africa is hearing a legal challenge by the Democratic Alliance (DA), a member of the Government of National Unity (GNU), against the Expropriation Act. The party is seeking an order declaring certain provisions of the Act unconstitutional and invalid, arguing that the law was adopted through a flawed and procedurally unfair process. They also say that parts of the legislation are vague and infringe on the constitutional protection of property rights. President Cyril Ramaphosa signed the Expropriation Act into law in January 2025. Lulu Gaboo spoke to Professor Ruth Hall, the Director of the Institute for Poverty, Land and Agrarian Studies, at the University of the Western Cape.
