A recent Labour Court judgment has raised an interesting question about returning to a workplace after a serious dispute with your employer.
The case involves former NSFAS budget accountant Zenobia Abrahams, who was dismissed after forwarding nine confidential work emails to her personal Gmail account. A CCMA commissioner later found her dismissal substantively unfair and ordered NSFAS to reinstate her with more than R1 million in back pay. NSFAS challenged that decision, and the Labour Court has now set the CCMA award aside and referred the matter back for a fresh arbitration.
But beyond the legal battle, it raises a very real workplace question: if you were fired by your employer and had to take the company to the CCMA to fight for your job, would you actually want to go back?
Even if the outcome went in your favour and you were offered your old position back, could you comfortably return to the same workplace, work under the same management and sit alongside the people involved in your dismissal?
