Gene examines a new Arizona law changing the rules for HOA foreclosure proceedings when homeowners fall behind on their association dues. The law extends the delinquency period before an HOA can foreclose from one year to 18 months and raises the delinquent amount threshold from $1,200 to $10,000 in many cases. It also requires the association to make reasonable efforts to communicate with the homeowner and offer a payment plan before filing a foreclosure action.

Gene looks at the issue from the perspective of homeowners and HOA boards, asking an important question: Is it fair to homeowners who consistently pay their dues on time if delinquent owners are given more time before facing foreclosure? The discussion explores the balance between protecting homeowners facing financial difficulties and ensuring that the costs of maintaining a community are fairly shared by everyone.
