Robert Mirabal on his Taos Pueblo roots, composing for a Hulu TV series, and starring in the film Road to Everywhere

This week on Voices of Taos join assistant editor Geoffrey Plant as he talks with Bryanna Baker, a victim of medical malpractice, and Cid Lopez, Baker's lawyer and a specialist in malpractice claims. During the interview, Baker shares her story of being pregnant and having a heart attack when she was 24 years old in 2006. Sadly she was misdiagnosed at two medical facilities in Northern New Mexico before she received adequate care. By the time doctors figured out what was wrong, she had suffered irreparable damage to her heart and lost her pregnancy. She filed a medical malpractice lawsuit and won, but Baker said her reward, which was capped under state statute at the time and significantly less than her $9.5 million verdict, is not adequate compensation. Lopez helped advocate for the cap to be raised in 2021, which has been a relief to victims of medical malpractice in the state. But medical providers, hospitals and public interest groups blame the state's shortage of physicians in part on the high cost of malpractice insurance in New Mexico, which ranks second in the nation for the number of malpractice lawsuits and first among states for insurance loss rates, according to U.S. Department of Health and Human Services data. Lopez says that other issues should be blamed for this shortage, such as the gross receipt tax on medical services and the low reimbursement for medicare.

Although he is currently the communications director for the New Mexico Department of Health, Robert returns to his old stomping grounds to share what he learned researching the Santa Fe New Mexican's history. The daily paper turned 175 years old on November 24th. Robert shares some of the treasures he uncovered, including the murder of a fortune teller. Laura and Robert also discuss how the daily paper kept tabs on Santa Fe and New Mexico's growth over the years and why local papers are essential parts of their local communities.

Join Assistant Editor Geoffrey Plant as he talks with Bernie Ellis, a Peñasco cannabis grower who gave away his crop this year instead of accepting the low price retailers offered him. Ellis believes federal cannabis prohibition is why he and other growers aren't fairly compensated for their pot. A former career public health epidemiologist who helped launch the nation's first state-level substance use disorder research program in New Mexico in the 1990s, Ellis discusses his underground weed-growing days in Tennessee, where for 15 years he donated his cannabis to AIDS and cancer patients. That, and his career in public health all came crashing down after federal agents busted his farm in 2002. On the day this episode was recorded, he received notice that the state is investigating what he calls his "Great Ganja Giveaway.”
