In Episode 20, Stuart McCullough invites Principal Workplace Relations Advisor, Tim Nagle, to discuss the Fitness to Work provisions of the enterprise agreements. Employers have common law obligations and entitlements around fitness for work where an employee's capacity is affected in a way that will impact how they can perform their role. What this clause establishes is a standardised and transparent process for employers and employees to address some of the potential fit for work issues which can be one of the most challenging and difficult circumstances to navigate. This would apply particularly in some circumstances where an employee may not have insight into the kinds of challenges that are apparent to the employer.
