The Pretoria High Court is today expected to make a ruling in the 20 years illegal cigarettes trading allegation against Hennie  Delport  by SARS. The R264 million case is against Delport for allegedly claiming false VAT and exercise duties from Sars resumes in the High Court in Pretoria today. Delport has cited collusion between the South African Revenue Service (Sars) and British American Tobacco (BAT) to shut him down. Former head of the National Prosecuting Authority Vusi Pikoli has told the Truth and Reconciliation Commission that the independence of the National Prosecuting Authority must be protected, even while maintaining cooperation with the government. Pikoli says his approach was always based on tactical flexibility, sharing information where necessary without compromising the NPA's constitutional independence. Pikoli also recalled a meeting with several ministers where concerns were raised about prosecutions linked to apartheid-era activities. He says some feared that pursuing certain cases could trigger renewed calls to prosecute former liberation movement members for actions before 1994. Suspended SAPS Organized Crime Head Richard Shibiri says he did not get himself involved but was tasked by General Shadrack Sibiya to find out what charges Katiso KT Molefe was arrested on. Shibiri was responding to Evidence Leader Lee Seegels-Ncube's question on his invoment in the arrest of Katiso KT Molefe whilst he was on leave and off duty.
