INTRO:
The National Treasury and South African Revenue Service are studying the Western Cape High court judgement declaring a major part of the Value-Added Tax Act unconstitutional.
The court declared section 7-subsection (4) of the VAT Act unconstitutional, finding the power to determine tax changes cannot be determined solely by the National Executive.
The DA and EFF approached the court following last year's budget process - when Minister Enoch Godongwana proposed raising VAT from 15 percent to 17 percent, before later scrapping it.
