The Constitutional Court handed down a landmark judgment clarifying that a customary marriage is a single, continuous union that is not dissolved when a couple subsequently enters into a civil marriage. In handing down judgement, the Court ruled that any Antenuptial Contract signed after the customary marriage (even if before the civil ceremony), is invalid unless it follows the strict court-supervised process for changing a property regime.
