In Colorado the answer is Yes.  Weld County Sheriff Steve Reams shares the story of having to release a man accused of violently assaulting a man in Greely.  The Sheriff had to let him go because it was determined he can't help with his own defense.  Not that he was mentally incompetent, but that he did not understand the system.
