Talk Law Radio BONUS: Why Should Federal Immigration Law Preempt State Law? with Shannon Salmón Haas & Alicia Perez

View descriptionShare

Attorney Todd Marquardt talks about the many significant court cases happening right now on this bonus edition of Talk Law Radio!

Local attorneys, Shannon Salmón Haas and Alicia Perez, explain why federal immigration law should preempt state law. The Texas legislature passed and Governor Abbott signed Senate Bill 4 in November 2023 which Amends the Texas Penal Code to include Chapter 51 entitled Illegal Entry into this State. Click the link https://statutes.capitol.texas.gov/Docs/PE/htm/PE.51.htm to read it. The new law was scheduled to become effective on March 6, but a lawsuit filed by the U.S. Department of Justice and Las Americas Immigrant Advocacy Center against THE STATE OF TEXAS; GREG ABBOTT, in his official capacity as Governor of Texas; TEXAS DEPARTMENT OF PUBLIC SAFETY; STEVEN C. MCCRAW, in his official capacity as Director of Texas Department of Public Safety stopped it from being enforced. Email host@TalkLawRadio.com if you want a copy of the complaint, the order granting the temporary injunction, the court of appeals' order granting a stay, or the United States Supreme Court order lifting the say. This case was also discussed in our show on March 10, 2024. Visit www.TalkLawRadio.com to find our archived shows. Attorneys, Shannon Salmón Haas and Alicia Perez, also mentioned how some undocumented women are afraid to report domestic violence because they are afraid of being deported under this new law. Contact Shannon Salmón Haas at https://salmonhaas.com/ Alicia added a side note about how law, including immigration law, should evolve from primarily penalizing in nature to something based on positive reinforcement. She didn't explain how that could actually work; maybe she will return again so that we have more time to discuss. The mission of Talk Law Radio is to help you discover your legal issue blind spots by listening to me talk about the law on the radio. The state bar of Texas is the state agency that governs attorney law licenses. The State Bar wants attorneys to inform the public about the law but does not want us to attempt to solve your individual legal problems upon the basis of general information. Instead, contact an attorney like Todd A. Marquardt at Marquardt Law Firm, P.C. to discuss your specific facts and circumstances of your unique situation.
