The Supreme Court on Friday stayed a D.C. district court order and let DHS keep using a modified SAVE system so states can verify voter citizenship. The 6–3 emergency-docket order comes 39 days before the Nov. 3 midterms. Mass purges inside the 90-day window remain restricted; individualized checks can proceed.
SAVE was built to check immigration status for benefits. The administration expanded it to include U.S.-born citizens, Social Security numbers, and bulk searches after Trump’s election-integrity executive order. A lower court had blocked that as a privacy and administrative-law violation. SCOTUS said those claims “likely lack merit” and that the federal government has a duty to answer state citizenship-verification requests.

Control of Congress is on the line. DHS calls it a win for election integrity. Voting and privacy groups say the database is error-prone, especially for naturalized citizens, and could chill lawful voters. The stay is temporary while the case continues.
