The AARTO Act and its Effect on Municipalities

In July 2023, the Constitutional Court ruled that the implementation of the Administrative Adjudication of Road Traffic Offences (Aarto) Act will remain in place. The AARTO Amendment Act aims to create a safer driving environment for all motorists and pedestrians and to ensure that offences are dealt with fairly. It is administered by the “Road Traffic Infringement Authority” (RTIA), which is a State-Owned Entity funded almost solely by traffic fines. Recently a report from from the Swellendam Local Municipality raised concerns about the financial impact of the Aarto Act. It warns of potential losses for municipalities ranging from R3.7 million to R5 million due to the Act's requirement to divert 50% of traffic fine revenue to the Road Traffic Infringement Authority (RTIA). However, the RTIA claims the Act will increase income for municipalities. Despite a scheduled July 2024 implementation, delays reportedly persist as the RTIA and Department of Transport finalise unresolved issues. In this conversation, we hope to gain clarity on what the Aarto legislation is, how it will affect motorists, what they should know when it comes to them understanding their rights at roadblocks and traffic centres as well as the implications for municipalities as we await its implementation.
