Legal President Cyril Ramaphosa is taking the 2022 Section 89 independent panel report on Phala Phala to judicial review. The review is separate from Parliament’s impeachment inquiry. Under the ConCourt ruling, the inquiry proceeds unless a court sets aside the Section 89 report. If the High Court finds the panel report flawed, it could be set aside and the basis for impeachment would fall away. One of the respondents in the court case is the ATM.
