In March, Stats SA reported that marriages in the country are on the decline particularly because of a possible cultural move away from the traditional institution of marriage which favours cohabitating agreements. It also indicated that more people are opting for customary marriages as opposed to civil unions. But what makes a customary marriage legitimate? We’ve heard of customary marriages being denied after the death of one of the parties and some even deny their marriages in hopes of taking on another wife or husband.
