The exclusion of independent candidates from elections through the imposition of barriers such as onerous signature requirements undermines the founding constitutional value of multiparty democracy. On 23 August 2023, the Chief Justice issued the directive for Rivonia Circle’s admission and further granted leave for the organisation to make written and oral submissions before the court when the matter is heard on 29 August 2023. Acting Executive Director at the Rivonia Circle, Lukhona Mnguni says the Rivonia Circle notes the importance of these directions by the Chief Justice given that the Minister of Home Affairs, the Speaker of the National Assembly and the Chairperson of the National Council of Provinces, had all – through their state attorneys – indicated that they would oppose the application for amicus curiae.
