A legal expert says the law provides for private prosecution of criminal cases to act as a safeguard against people taking matters into their own hands - but only if the state decides not to prosecute a case. At the same time, safeguards are built into legislation to prevent people from conducting a vendetta through the courts. This, as the private prosecution by former President Jacob Zuma of prosecutor Billy Downer and journalist Karyn Maughan - is to be heard in the Pietermaritzburg High Court.
