A Western Cape High Court precedent has contextualised the Islamic practice of nafakah in the application of South African law. Nafakah relates to spousal maintenance that a husband is duty bound to pay to his wife. In a case brought before the court- a Cape Town attorney was successful in her application for compensation from her ex-husband for the expenses she incurred in the maintenance of their household. It's too soon to tell if EFF Leader Julius Malema will end up in prison. This as leave to appeal the five year sentence for unlawfully possessing of a firearm begins in earnest. Malema's legal team has a week to submit the application for leave to appeal. The court however dismissed the application by the defence to appeal the conviction. Julius Malema has been sentenced to five years direct imprisonment for unlawful possession of a firearm and two years imprisonment for unlawful possession of ammunition. The sentences will run concurrently. Malema was found guilty of contravening firearm controls when he discharged an automatic rifle in the air during the EFF's fifth birthday celebration in Mdantsane in 2018. To discuss the avenues available to Malema we were joined by Lawson Naidoo (Executive Secretary of the Council for the Advancement of the South African Constitution) and Prof. Ntsikelelo Breakfast (political expert).
