The date is set for the case of the StopTheBantustans Campaign to be heard at the Constitutional Court. On Thursday 23 February 2023 at 10h00 the appeal against passing of Traditional and KhoiSan Leadership Act 3 of 2019, which denies citizens of rural communities their rights as customary landowners and members of traditional communities, will be decided upon in the Constitutional Court. The applicants are Constance Mogale, National Coordinator of the Alliance for Rural Democracy; Land Access Movement of South Africa (LAMOSA); Mashona Wetu Dlamini, a member of Umgungundlovu community and Victor Modimakwane, a member of Bakgatla ba Kgafela community. These applicants have previously appealed to law makers and Parliament committees regarding the unbalanced power that Traditional and Khoi-San Leadership Act (TKLA) gives to traditional leaders who are enables to negotiate and sign financial contracts with profit seeking companies without needing to consult with members of their communities. This opens avenues for illicit and harmful violations that impact the livelihood of community members, which is seen in instances such as mining and commercial agriculture.
