Pierre, SD (KELO-AM) South Dakota is just one signature away from becoming the first state in the nation with a transgender bathroom law.

The legislation already passed by the State House, was approved Tuesday by the State Senate by a close vote of 20-15, after long, sometimes emotional, debate and several attempts by minority Democrats to water down the bill by amendment.

Democratic State Senator Bernie Hunhoff of Yankton warned about the national repercussions to a bathroom law, including a possible boycott of South Dakota tourism. South Dakota could wind up "with egg on its face" argued Hunhoff.

Republican State Senator Brock Greenfield from Clark said at issue is "do you feel it appropriate for a 13 year old girl to be exposed to the anatomy of a boy, or a 13 year old boy to be exposed to the anatomy of a girl?"

The legislation requires that students used bath rooms and locker rooms based on their biology, not their choice. Special accomodations would be provided for students who insisted on choice.

The bathroom bill now goes to Governor Daugaard, who has said he hasn't made a final decision yet on whether or not to sign it into law.
