There’s no doubt that the evolution of data over the last 20 to 30 years has been significant. The challenges that we are facing in Asia, along with the types of emerging data that we are now encountering and how these need to be integrated into our investigations, are staggering. Following on from part I in our Corporate Investigations series, our host Sandeep Jadav is joined by Scott Warren (Squire Patton Boggs) and colleague Tim Anderson to discuss the changes that they have observed, the explosion of data types that we are encountering post-Covid, and suggested strategies in dealing with the extended data universe.

Topics covered in this episode include:

  • Evolution of Investigations – moving digital evidence out of China, current challenges and recommendations for companies.
  • Emerging data sources – what are these, why are they important to investigations and how are they changing.
  • Data integration – how to deal with such disparate set of data types, the use of Technology Assisted Review (“TAR”) and how emerging data fits into this picture.

Note: on August 20, 2021, the PRC passed the Personal Information Protection Law, which was still in draft form when Scott recorded his comments.  For a full breakdown of the law, please see Scott’s summary at: https://www.securityprivacybytes.com/2021/09/new-prc-personal-information-protection-law-passed-a-deeper-dive-into-the-provisions/
