This evening on Constitutionally Speaking, we talk to Prof Hugh Corder, Professor Emeritus of Public Law, University of Cape Town, who’s written a very interesting article on The Conversation titled “South Africa’s Constitutional Court at 30: a solid foundation but cracks are showing”. The article looks at the record of the apex court in dealing cases that attempt to understand how the law should understood and interpreted on the background of our constitution. It highlights some of the challenges that the court has encountered but as the Dr Corder says “Constitutional Court has played a leading role in realising constitutional justice over the past 30 years, exceeding the expectations of many sceptics. However, many forces seek to undermine its role, and civil society needs to be resolute in defence of the court, while holding it to account and assisting it to remain true to its mandate.”
