The Western Cape High Court has ruled that a privately built pool, terrace and outside entertainment area at an apartments complex in Hermanus was, in fact, built on coastal public property. The matter came about as a result of efforts to complete a 12-kilometer footpath from Hermanus’ new harbour in the west to Grotto beach in the east but found that it was in the way.
